LIMITED WARRANTY The Tartan Commitment.
You have purchased one of the finest sailboats built in the world today. And it is supported by one of the finest warranties in the industry. This excellent warranty coverage demonstrates not only our confidence in our Tartan sailboats, but also our commitment to every Tartan customer. We're dedicated to ensuring that you enjoy exceptional quality, dependability and peace of mind throughout your ownership experience.
To further demonstrate our commitment to our Tartan owners' satisfaction, we may establish a special policy adjustment to pay for specific repairs that are no longer covered by warranty. When we establish such a policy adjustment, we mail details to all applicable owners on record. That's why it is important to send in the Warranty Registration Form supplied to you with your purchase documents, and to notify us when you change your address, or if you have purchased your Tartan from a previous owner.

This warranty is effective for all Tartan yachts delivered after November 1, 2003.
Who is the Warrantor:
The warrantor for these limited warranties is Tartan Yachts, a division of Fairport Yachts, Ltd., 1920 Fairport Nursery Rd., Fairport Harbor, OH 44077.
Which Vessels Are Covered
This warranty applies to all new Tartan sailboats delivered to owners after November 1, 2003, and normally operated in the United States, U.S. territories and Canada.
The owner must submit a fully completed Warranty Registration Form through an authorized Tartan dealer within thirty (30) days of the purchase of the vessel.
It is important that this form be submitted on a timely basis to Tartan Yachts. Failure to do so will invalidate the warranty.
Is The Warranty Transferable:
Warranty coverage is transferable to the first subsequent owner of the vessel upon application to Tartan Yachts and upon the following conditions:
The vessel must be surveyed by a surveyor who is a member of the Society of Accredited Marine Surveyors, and a copy provided to Tartan Yachts. The survey must disclose that the hull is in good condition, free of damage or defects. The vessel must be listed for sale with, or be accepted as a trade-in by, an authorized dealer for Fairport Yachts products.
A completed Request For Transfer of Warranty form, available from Tartan dealers, must be completed and forwarded to Tartan Yachts for approval together with the marine survey. The transferee is the first transferee after the original owner. The vessel is not, or has not been, in charter service or used for commercial purposes.
The remaining term of the Structural Warranty and the Blister Warranty will be adjusted according to the following schedule:

When Warranty Begins:
The warranty period begins on the earlier of (a) the first date the vessel is delivered to an ultimate purchaser, leased, or used as a demonstrator by the dealer, or (b) the first day of the thirteenth month after the vessel's manufacture.
Repairs Made at No Charge
Repairs and adjustments covered by these warranties are made at no charge for parts and labor.
Parts Replacement:
Any needed parts replacement will be made using new or remanufactured parts. The decision whether a part should be repaired or replaced will be made by Tartan Yachts. Remanufactured parts meet or exceed all factory standards for safety, quality and reliability.
Limitations:
The performance of necessary repairs and adjustments is the exclusive remedy under these warranties or any implied warranties. Tartan Yachts does not authorize any person to create for it any other obligation or liability in connection with this vessel.
Any implied warranty of merchantability or fitness for a particular purpose is limited to the duration of these written warranties. Some states do not allow restrictions on how long an implied warranty lasts, so this limitation may not apply to you.
What Is Covered And How Long:
Our warranty program consists of three warranties. Coverage under each is subject to the exceptions indicated under "What Is Not Covered" set forth below.
Basic Warranty. This warranty covers repairs and adjustments needed to correct defects in materials or workmanship of any part supplied by Tartan Yachts. Coverage is for twelve (12) months.
Structural Warranty. This warranty covers repairs and adjustments needed to correct defects in chain plates, mast step and floor timbers. Coverage is for fifteen (15) years.
Blister Warranty. This warranty covers repairs and adjustments needed to correct defects resulting from osmotic blistering in below-the-water gel coat surfaces of the hull. This warranty does not apply to keels, rudders and other painted surfaces. Coverage is for fifteen (15) years.
What Is Not Covered
This warranty does not cover damage or failures resulting directly or indirectly from any of the following:
Abuse or negligence
Improper commissioning, repairs or storage.
Alteration, tampering, or rigging changes including installation of non-genuine Tartan parts or accessories.
Lack of or improper maintenance.
Installation of non-genuine Tartan parts.
Environmental conditions such as airborne chemicals, salt, hail, and lightning.
Fire, accidents or theft.
Paints, varnishes, gel coats, chrome-plated or anodized finishes and other surface coatings other than as specifically described in the Blister Warranty.
Wooden parts that have warped, expanded or contracted.
Other Exclusions:
This warranty also does not cover the following:
Any charter or commercial use of the vessel invalidates this warranty. A special warranty is available from Tartan Yachts for these uses through Tartan's Warranty & Service Department.
Components, equipment and accessories not manufactured by Tartan Yachts, including but not limited to engines, pumps, batteries, deck hardware, rigging, heating/cooling units or systems, refrigeration, plumbing and electronic equipment. These items, although installed by Tartan or an authorized dealer, may be covered in warranties provided by the original manufacturer.
Any vessel which has been the subject of a lightning strike or grounding, unless the owner provides Tartan Yachts with a marine survey from a surveyor who is a member of the Society of Accredited Marine Surveyors that demonstrates that the vessel is in good and seaworthy condition in the sole discretion of Tartan Yachts.
Damage or repairs resulting from osmotic blistering as described in the Blister Warranty if gel coat has been sanded, sandblasted or subjected to abrasives, or damaged by impact or contact.
Cracks in finishes which might appear at the hull-to-keel ballast joint. These are normal and should not be considered as evidence of structural damage, defective workmanship or material. Leaks at stanchions, chain plates, and genoa tracks in the course of normal operation of the boat. These are normal and considered a part of normal maintenance.
Any vessel that has been the subject of rigging changes without the written approval of Tartan Yachts.
Noise, vibration, cosmetic conditions and other deterioration caused by normal wear and tear. Any vessel for which the original factory-assigned hull identification number cannot be determined.
Any vessel that has ever been issued a "salvage" title or similar title under any state's law; or has ever been declared a "total loss" or equivalent by a financial institution or insurer, such as by payment for a claim in lieu of repairs because the cost of repairs exceeded the cash value of the vehicle.
Incidental or consequential damages associated with a vessel's failure. Such damages include but are not limited to inconvenience; the cost of transportation telephone calls and lodging; the loss of personal or commercial property; and the loss of pay or revenue.
Disclaimer of Extra Expenses and Damages:
The performance of necessary repairs and adjustments is the exclusive remedy under this warranty or any implied warranty. Tartan Yachts does not authorize any person to create for it any other obligation or liability in connection with this vessel. Tartan Yachts shall not be liable for incidental or consequential damages resulting from breach or this written warranty or any implied warranty.
Any implied warranty of merchantability or fitness for a particular purpose is limited to the duration of this written warranty, except in states where this limitation is not allowed.
How to Present Claims:
Warranty claims must be presented through an authorized Tartan dealer within 30 days after discovery of the defect.
ALL CLAIMS MUST FIRST RECEIVE A WRITTEN OR EMAIL WARRANTY AUTHORIZATION FROM TARTAN YACHTS BEFORE ANY WORK CAN BE PERFORMED. NO WORK PERFORMED BEFORE THE AUTHORIZATION IS PROVIDED WILL BE APPROVED FOR PAYMENT.
All information requested by Tartan must be provided by the owner on a timely basis including, but not limited to, pictures of the damaged area or components, quotations or estimates of repair costs, and all other information concerning the cause of, and costs associated with the repair of, the damaged area. Tartan reserves the right to select the yard or contractor to perform the repairs, and the materials to be used.
Tartan Yachts shall have the right to inspect the boat prior to the approval of a warranty claim to determine the validity of the claim and the nature of the defect. Such inspection may involve the removal of a core sample of laminate.
In the event that Tartan Yachts approves a claim under the Structural Warranty or the Blister Warranty, Tartan Yachts may, at its option purchase the vessel from the owner for the original purchase price of the vessel. All charges for authorized warranty repairs must be submitted within a period of thirty (30) days of the performance of the work on forms provided by Tartan. These forms are available through an authorized Tartan dealer or at www.tartanyachts.com.
